A former gymnastics coach for the Rome-Floyd Parks and Recreation Authority who was acquitted of theft charges by a jury has filed a federal lawsuit against the authority, Executive Director Richard Garland, the City of Rome and Floyd County for malicious prosecution.

In her lawsuit — filed in U.S. District Court in Rome on Friday — Karen Arm­strong said Garland and others acting his behalf “made statements to authorities that were knowingly false or, in the alternative, were made with a reckless disregard to the truth or falsity of the statements.”

Armstrong was acquitted of theft charges after a weeklong trial in March 2012.

According to her lawsuit, Armstrong, a coach for more than 30 years, began working for the RFPRA in December 2007.

She collected money from parents for a separate team, called the “Flip City” team, and deposited the funds into her account to pay for team expenses.

Garland reported to Rome police that Arm­strong had misappropriated funds from parents by personally accepting money instead of running it through the RFPRA books.

Armstrong said in her suit that, despite the fact she accounted for all of the money, Garland manipulated the investigation by withholding information and evidence.

In one instance, Garland did not provide cash receipt books to the police, according to the lawsuit. Armstrong accuses Garland of hiding them from authorities and saying the funds in the receipt books were stolen by Arm­strong.

In Armstrong’s trial held in March 2012, Garland said the books were found months after the investigation “stuffed away in a concession stand cabinet next to Armstrong’s office.”

But Armstrong’s attorney found an internal memo to Garland that told him the receipt books were found on Armstrong’s desk the day Armstrong was suspended, on Feb. 9, 2010.

Jerry Lee, chairman of the RFPRA board, said the authority was not at fault.

“We didn’t prosecute her,” Lee said. “It was the police that did the investigation. It was the (district attorney) that prosecuted her. I don’t see how she has any claim against the parks and recreation board.”

Garland did not return a phone call seeking comment.

James Radford, a Decatur attorney representing Armstrong, said they did consider including the police in the lawsuit. As for district attorneys, they have “almost complete immunity,” he said.

The suit is asking for unspecified damages for malicious prosecution and intentional infliction of emotional distress as well as punitive damages.

Souds to me that the Authority is at fault. It also sounds as if Mr. Garland might be guilty of perjury or at the very least the hindering of an official police investigation. Also, any other employees or board members who withheld information should be prosecuted.

Ms Armstrong deserves compensation for this and the Board and Mr. Garland should be liable for her damages.

In other news RFPRA all-star basketball 10and under girls took second place at the State championships today. Not interesting enough for RN-T, but a lawsuit, yep. SMH Hopefully the Recre will do something else stupid so that RN-T has something recre related to cover. God forbid they point out that some locals do well on a State level. - RT

Didn't they tell you why they didn't cover that "were number 2" breaking news,Noldea?

Probably because, just like most people, you didn't bother to call the rome news and tell them about it.

Nobody really cares about this except their parents, coaches, or possibly other family.

You have to call things like this into the rome news and they WILL write a brief article for the online version of the paper.

It's called personal responsibility. That means you do it yourself and don't just assume it will just happen or count on someone else to do it.

Mr. Jerry Lee your statement is absolutely stupid. As a board member you could have looked at this problem before any charges were brought and stopped this from happening. I hope she gets every penny she deserves.

I agree, fishoman420. I don't know Mr. Lee or his qualifications/experience. But, his statement casts a bad light on RFPRA and his leadership. Mr. Lee, "IF" an employee/person of authority falsely accuses another of wrong doing, it is a lawsuit." IF" that same person makes false statements to police investigators it is a crime and possible lawsuit. "IF" evidence clearing the accused is intentionally with held it is possibly a chargeable crime and a lawsuit. Maybe Mr. lee can blame the judge for allowing the trial.
