Waterclub alcohol license suspended, locals fired up

Groans of frustration could be heard in the corridors of Cave Spring’s City Hall on Monday after City Council members decided in a 3-1 vote to suspend the Waterclub’s alcohol license for three days, a decision which Mayor Rob Ware said he would seriously consider vetoing in the days to come.

Council members called the meeting to address three ordinances the restaurant allegedly violated since they opened Feb. 23, and Waterclub owners Jeff and K.C. Myers were there to defend their business, which they said could not flourish if their license to serve alcohol was suspended or revoked.

Council members Mary Littlejohn and Ken Landers maintained that on more than one occasion, they witnessed the violation of three ordinances that state the restaurant cannot advertise their sale of alcohol outside, that customers cannot consume alcohol outside and that the restaurant cannot serve alcohol after 10 p.m.

The Myers, who were supported by more than 40 locals who were passionate about the Waterclub and what the restaurant has done to bring more economic growth to their small town, admitted that they had a chalkboard sign outside that did advertise their sale of wine and beer.

“When that was brought to our attention, we brought that inside immediately,” Jeff Myers told the council. “Certainly, that was out front, but you won’t see it again.”

Landers brought up an incident on June 23 when he saw six to eight people sitting outside at about 10:30 p.m. with wine glasses at their table.

Landers went inside and told the Myers they were violating another ordinance.

Jeff Myers said after that night, a sign was put near the door telling customers, “Please, no alcohol outside.”

Another issue discussed was whether or not the restaurant could remain open after 10 p.m. Council member Littlejohn said after she saw lights on in the restaurant past 10 p.m., several times, the Myers were in violation of another ordinance.

“The ordinance doesn’t say that you can’t be open past 10 o’clock,” Attorney Zach Burkhalter clarified. “The ordinance says that if you are open to the public past 10 o’clock, then that constitutes evidence that alcohol is being consumed on the premises. It just creates the legal presumption that alcohol is being served in violation of the ordinance.”

Jeff Myers said he and his wife valued Cave Spring and the chance to contribute to its economic growth.

“Our duty here is to build the economy,” he said. “We have a successful business that is inviting people into this community.”

Ware then gave the public a chance to express their opinion, and more than 10 locals said the Waterclub has done nothing but better the community of Cave Spring.

Donna Staples, owner of Country Cousins, and a Downtown Development Authority board member, said having businesses like the Waterclub would bring more merchants into town so Cave Spring will have a thriving downtown area.

“It’s really hard to do that when everything that comes out of this community and into the news media is so negative, and it’s really to the point of absurd, because we are in the 21st century, believe it or not,” said Staples. “It’s asking us to do the impossible because we’re trying to work with our hands tied behind our backs. There are ordinances that need to be in place that are so much more important than the one we’re addressing today.”

The room rang with applause when Staples took her seat, and other locals expressed that they too thought reprimanding the restaurant for the violated ordinances was silly.

When Littlejohn asked the Myers how many times they stayed open after 10 p.m., the rest of her question was drowned out by boos from the crowd.

“I think this is something that could be worked out without … It’s almost like a witch hunt, I don’t like it, I don’t like it,” said Council member Nellie McCain. “As a council member, I don’t feel like it’s my place to go around and police you.”

Ware suggested that instead of voting on a three-day suspension, which he considered too extreme in this case, that a stern letter of warning be issued to the Myers. However, Landers motioned for a three-day suspension, and the City Council voted 3-1 for a three-day suspension, with McCain casting the sole no vote.

Council member Robin Clements was not present for the vote.

“I will tell all of you I reserve the right to veto your action and I will think about it,” Ware told the council.

Jeff Myers said after the meeting that he and his wife were grateful so many community members showed up to support them.

“I think the support was amazing,” he said. “I don’t think Cave Spring is used to seeing that kind of turnout for any kind of decision, so I think that in itself is a great thing for Cave Spring. “

K.C. Myers said the meeting brought some possibly heftier issues to light for the community to take into consideration.

“I think it gives the town a voice, and we’ll be figuring out … who do you really want running this town? Are these the people you really want speaking for your city?” she said.

Overall, Jeff Myers said locals’ standing up for the business gave Cave Spring a strong sense of unity.

“I think this town has been asleep in some regards and I think something such as Waterclub has given people something to fight for,” he said.

So, let me get this straight. A couple of council members (Littlejohn and Landers) want a bar (the Waterhole) to abide by city ordinances and vote to penalize them for not upholding community standards and certain people in the town want to oust these council members? O.k. so, I guess the next logical question is: Do the people who are trying to oust these council members (for doing their job) have a vested interest in the bar? Are they shareholders, patrons, or friends of the owner of the bar? If Littlejohn and Landers get ousted, I suggest they run for office in Rome and do some "cleaning up" in Rome where crime, drunkedness, and other un-Christian behaviors are on the rise. By the way, it seems strange that the mayor is not supporting his council members unless he also has an interest in the bar or maybe he is up for election and fears that Landers or Littlejohn might oust him in an election? Hmmm....small town politics...so exciting (not really). In the end it is all about money, period. Someone is making money off of alcohol sales in Cave Springs and the town has to decide whether the money is more important than the integrity, safety, and well-being of the community. Let's see what the town decides: Money or Morality.

(My guess is that money will win over morality - it usually does).

The ordinances they are forced to abide by are a joke, no where in Atlanta or any other thriving city in America are there such restrictions placed on establishments.

Your thinking will never let your town grow and prosper, i imagine you are retired living on fixed income and don't much care about opportunity for others.

the other poster below commented, it time to come out of the 18th century. Whats wrong with having a drink, after all Jesus turned water into wine not grape juice.

Sounds to me like the mayor is looking more at the "big picture" than instead of being petty. The mayor is looking out for the growth of Cave Spring instead trying to keep it in the dark ages. Also since most of the residents at the council meeting were against punishing the business i would say he will following what the residents want him to do since they are the ones who elected him. In another article the business owner stated that after they were made aware of the city ordinances he quickly corrected the problems. I can understand if these were repeated violations but form i can understand this is the 1st time it happened.

It is apparent to me, and many others including quite a few residents of Cave Spring, that the two council members have some sort of reason they dont want this business to be successful. Seems to me that they would want to help new businesses to be profitable & successful so that the town may grow and profit from new businesses.

As with many small towns politics play a major role on how the town prospers. When you have city council members who sit across the street from a business watching & waiting for them to make a false move it inhibits the growth of the town because people wanting to start a new business or move their existing business will look elsewhere and find a city or town who will embrace them instead of continuously throwing obstacles in their way.

Since the statement was made that maybe the mayor has some sort of interest in the business maybe someone should check and see what interests these two particular council members have in the businesses in Cave Spring. Could it be that this business is in competition with a business they have a financial interest in? If something like that is true then they should exclude themselves from any decisions regrading this business or any other business that may be in direct competition with any business they have a financial interest in.

Bottom line it sounds like to me some of the citizens of Cave Spring are tired of city council members who want to use their power to advance their own agendas and to keep the town from growing.

For those of you who do not live in Cave Spring, you wouldn't understand that our little community is still being run like we are in the 18th century. We citizens of Cave Spring are ready for CHANGE!!! Change is good and its about time we stand up because we want prospering new business to come so that Cave Spring can continue on, we dont just want people to pass through as they are going out of town. We want new life, new citizens and new business but inorder to get that, we have to welcome them with open arms, not push them away because they can't follow some ordinances that have never been revamped in 20 years.... You shouldn't throw stones at those trying to make a small town better especially if you dont live there and are not able to experience and see stores come and go and the way it is run. We want to make this one red light town what it should be!

WWROME,FYI,it is Cave Spring. We only have 1 cave and 1 spring. For everyone who doesnt live in Cave Spring, we dont mind the tourists,but dont try to push your opinion on us. I completely agree with the decision,because i have personally seen the drinkers outside. we have a deaf school here for those of you who dont know this,thus meaning there are deaf people living here. if these people get drunk and drive,guess wg

hat somebody could get hurt.so what is the big deal with losing your pouring license for 3 days. im pretty sure it would happen to anyone else,from Atlanta or anywhere else.

That's an interesting point about all the deaf people in Cave Spring (because of the state school there).

How does this affect life for others in Cave Spring? What are the implications for civic life there? For example, different signage, traffic safety rules, etc? How deaf-friendly are local businesses?

For that matter, is there more Rome or Floyd County could do to make this a friendlier place for our deaf neighbors?

This is ridiculous!! The ordinance says they can't serve alcohol after 10pm. So if last call is at 9:59 it doesn't mean that the drink has to be consumed by 10pm. Also, should the Waterclub force people out the door at 10? What about the people that like to sit around talking after their meal while sipping on wine? Doesn't mean they are getting drunk. It's a shame that this family can't run their business without being nit-picked. I haven't been to the restaurant yet but will be going this weekend before they are ran out of town by these "concerned citizens". Good luck Waterclub! I hope you do make it in Cave Spring because except for the Mexican restaurant, there isn't anywhere left that is good to eat!

the owner said he VALUED cave spring but he will soon find that unless he is from cave spring they will not VALUE him the town is backwards and always has been they want no progress only quite antique stores that cannot supprot themselves with sales from the comunity.

Now if they were and old dilapidated building like the so called cabin then they would be throwing good maoney after bad to help them.

lightning should strike the CABIN and put it out of its misery so that bad money could be used for something worth while.

business owners around are jealous when someone outside comes in and apparently does well.

good luck to the waterclub for if the town has its way it will soon be out of business and another building will be empty and just sitting around to rot tot he ground so then they can start trying to raise money to restore it.

Cabin Fever, I have it and I am SICK of it.

Mean old man could only be stinky on the corner. Godfry. Everyone who has ever had anything stolen in Cave Spring or surrounding areas should first look and see if it is sitting outside his "country store"(junk store). He is notorious for riding around Floyd County and just putting whatever he finds in the back of his truck. He also does this in Polk County. He is a thief!!! Ask the owner of the resturant on the corner. Last time they changed ownership he stole all the tables and chairs out of there and resold them. Cave Spring is a dump. Empty store fronts, weirdo's randomly walking the streets, many very "slow" people who spend the day drunk under a tree. Delapidated homes, terrible roads, and alot of slumlords. On a bright note we do have a very nice park. Back to the real town, if you are a little slow or retarded and have a drinking problem then Cave Spring is the place for you

You from Cave Spring have got to be kidding. So you are incensed by the behavior going on in your town with wind drinking on the sidewalk and dancing on the tables. For years that area of town called the square has been a place for underage drinking, fighting, smoking pot, and everythhing else that you can think of since before my youthful days back in the 60's. Why is it a problem now? I remember in the past that all the police did was sleep in is police car or look on in boredom.

Take your town back? You mean take your town back from the outsiders. Yeah, that's really what you mean. The ones complaining are probably the trashiest,pretending-to-be-high-class people in town. You're not fooling anyone Cave Spring elite.

Gatorchomp and Broadst -- again a call to step up and use your names. If you have the courage of these convictions, why not?

I have no personal agenda with Ms. Littlejohn. I did not run against her in this last election. That was Rebecca Francois. I have never run for City Council. I disagree with Ms. Littlejohn's decisions as a Councilperson over a period of time. She's a decent artist and I'm sure, a fine person. She will find a more suitable way to serve the public.

I again suggest you two come to Council meetings and learn all the facts of this situation and others before you make up your minds. Your statements about this situation are just not on target. Happy to discuss at meeting sometime.

Waterclub, document everything (audio and video). Retain a competent attorney on a contingency basis. You will own the City of Cave Spring and you can do as you darn well please with the entire town.

The WaterClub caused a contingency because the city cited a store in Cave Spring for violating an ordinance of the similar nature. City charged them $1200 and suspended their license for 3 days. Now that the WaterClub has violated it, they only proposed suspended their license for 3 days. Our "illustrious" mayor is now wanting to veto that vote from the council. So, WaterClub is getting preferential treatment. Why would they get a lawyer to fight?

Why doesn't Cave Spring just put a sign up that says "Business, Tourists, Families, Friends, or Outsiders Are NOT Welcome"? The way this town treats the business community and visitors is up hauling. I've had a gun pulled on me at the "county store" on the corner by some mean old man, almost been run over by meth addicts on the street, watched prostitutes leave the "Motel" while fishing with my son, and fell through a porch with my family while visiting the "Antique store" off the square. Why are these three council members so worried about me and my wife having a cold beer after working full time? After reading about this crazy story, I'm convinced there is nothing but meth addicts, prostitutes, and "christian" crusaders crusading against all the wrong things.

Goodbye Cave Spring, because this man's wealthy family won't be driving through that junk hole ANYWMORE!

I have never been to your establishment, but my parents and friends have and they were very complimentary. I am hoping to visit soon. If you broke the ordinances, just take the punishment and move on. It sounds like you have a lot of supporters and I would hope that one 3 day stint with no alcohol would not keep them from coming in and eating. It certainly wouldn't affect me. If I want to drink, I usually do it at home anyway. Seems like much ado about nothing to me. I hope that you stay in Cave Spring and do well if you are making a positive change in the local economy and giving the good folks that live here a nice place to eat and visit with friends and family. Many folks from Cave Spring just adore Mary and Flanders but I for one am here to tell you these 2 are the reason Cave Spring has no economy. They should have been voted out in the last election but MAry pulled the wool over many of your eyes. Take a look at her run down house and the many city ordinances it violates and nothing has been done to correct it.

Also, if you want meth, pot or you are underage just step into the little store by the creek and he will sell you anything you want. Alcohol your preference? No matter your age CASH will sell it to you and if you get the munchies after eating next door...well you figure it out.

After pondering the dancing accusations, I figured it out, We have customers/friends whom have a 13 yr old daughter who is a gymnist and takes dance classes. We will sit outside from time to time with her parents and she will want to perform. She is an only child and LOVES the attention. We can't make her stop or squelch her spirit. She dances 90% of the time I see her. We will be in conversation with her parents, and you will hear her start a dance with "5,6,7,8," and start dancing! She loves it! So, You are not crazy. You did see someone dancing, but it is not a drunk, crazy, wild one. Sorry, you are so quick to attack us and rumor wrong doings. GIVE US A CHANCE!

Hmmmmm, were we supposed to know this information? All we see happening is a female dancing outside a place where drunks tend to leave and stagger down the road. Dianna--that's not gossip that's a fact! I have witnessed these people on several occassions.

I am very sad. Business in today's economical climate is hard enough with just the taxes, regulations, theft, etc. small businesses deal with every day. When you compound this with petty bickering, and unreasonable expectations, and ordinances with more "gray" areas than black and white, this is what you end up with. Everyone needs to take a breath and act civil.
