Sheriff's Office: Deputy resigns after fight at a restaurant bar in Alabama

A Floyd County sheriff’s deputy resigned Sunday after what sheriff’s officials said was a fight at a restaurant-bar in Alabama where witnesses claimed that shots had been fired.

Daniel Kirby was assigned to field operations in the warrant division, Chief Deputy Tom Caldwell said Sunday.

“Mr. Kirby was scheduled to meet at the sheriff’s office today with Field Operations Commander Tommy McGuire to discuss the incident but tendered his written resignation upon arrival,” a news release from the sheriff’s office sent out on Sunday afternoon stated.

The incident reportedly happened at The Gridiron in Centre.

Caldwell was notified about 2:30 a.m. by officers at the scene that Kirby had been involved, and that witnesses claimed that shots had been fired “by someone in the parking lot after a fight had occurred,” according to the release.

“Centre Police arrested Deputy Kirby’s brother, Justin Kirby, after both had attempted to flee the scene in Deputy Kirby’s vehicle,” the news release said. “The tag of the vehicle was verified as being registered to Daniel Kirby. Deputy Kirby was never located during a search for him and turned himself in to the Centre Police Department shortly after noon on Sunday.”

According to Cherokee County, Ala. online jail records, Justin Kirby was booked at 2:05 a.m. on a charge of public intoxication and was released at 9:45 a.m. on a $300 bond.

The records showed no arrest or charges for Daniel Kirby as of Sunday evening.

In the news release, all questions about the case were referred to Centre Police Chief Kirk Blankenship. Blankenship did not immediately return a phone call seeking comment and a person who answered the phone at the Centre Police Department said he was off until Tuesday.
