Mathis, who resigned in 2010 and was arrested on 27 charges in July 2010, was arrested again on Friday night on two new counts of theft by deception and theft by taking. He was out on bond on the 2010 charges but is now being held without bond for allegedly committing new crimes.
The new charges were filed in connection with an incident reported to law enforcement within the last month that allegedly happened in April, said District Attorney Leigh Patterson. She has declined to discuss the most recent details.
The indictments, handed down late Friday, include four counts of felony deposit account fraud, fourteen counts of theft by taking, thirteen counts of theft by conversion, fourteen counts of theft by deception, five counts of exploitation of the elderly, one count of first degree forgery, one count of secreting property to defraud, one count of theft of livestock and one count of violation of his oath of office.
Mathis is accused of violating his oath of office for committing the offenses while chief magistrate, according to the indictments. However, the charges are not related to the magistrate court but to Mathis’ cattle business.
According to the indictments:
- Mathis wrote four bad checks, one to Linda Evans for $32,724.14 dated Nov. 14, 2008; one to James Collins dated May 29, 2009 for $61,000; one to Barry Henderson dated April 27, 2010 for $44,106.23 and one to John Dudley on April 29, 2010 for $39,600.
- Between Feb. 2008 and July 8, 2010, Mathis had $25,000 belonging to Linda and Donald Evans that was to be used to buy cattle. “The accused had no intention of purchasing cattle for shared ownership,” the indictment stated. The exploitation of an elder person charge was filed because the Evanses are 65 years of age or older.
- Other alleged victims of the cattle sale scheme in the indictments are Wade Hoyt IV, Joe Henderson, Mohammed Abbasi, Sherold and David Salmon, Betty and Lewis Hayes, Charles A. Hight Jr., Mark Drew Vann, Ray J. Tate, Sr., Earl and Eleanor Godfrey and Steve Lanier.
Mathis is accused of taking a John Deer tractor and a loader and damaging, destroying and hiding the property from Bob Johnstone between May 19, 2010 and July 8, 2010. - He is accused of taking 21 cows from Donna and Harold Mantooth.
