Hershey, which says it's the largest producer of chocolate in North America and had 2011 sales of $6 billion, has told Dalton, Ga.-based Shaw, one of the country's largest carpet makers, to stop using the name "Chocolate Kiss" as a name for one of carpet collections.
Hershey says Shaw is violating its trademarks. In a December letter to Shaw, attorneys for Hershey wrote that "Due to the fame associated with the Kisses Trademark, we assume that you were aware of such rights when you began advertising and selling the Infringing Merchandise. Therefore, this product appears to be a blatant attempt to draw upon the goodwill associated with the Kisses Trademark and profit from our client's proprietary rights."
